Maptainer is a computerized maintenance management system (CMMS) platform with GIS capabilities, specialized in intelligent street lighting management. Our Services include:

3. Registration and User Account
3.1. Registration requirements
To access certain features of the Services, you must create an account. By registering, you represent that:
- You are at least 18 years old or have legal capacity to contract.
- You provide truthful, accurate, and complete information.
- You will act on behalf of a legally constituted organization, if applicable.

5. Intellectual Property
5.1. Maptainer's rights
Maptainer and its licensors own all intellectual property rights over:

- The design, user interface, and user experience.
- Trademarks, logos, and distinctive elements.
- Documentation, manuals, and training materials.
- Any improvement, update, or derivative development.
5.2. License of use
Subject to compliance with these Terms and payment of applicable fees, Maptainer grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services during the subscription period.
5.3. Your data
You retain all rights to the data you enter into the platform. You grant us a license to process such data solely for the purpose of providing the Services.
6. User Content
You are solely responsible for content you upload, store, or transmit through the Services, including:
- Asset and inventory data.
- Photographs, documents, and attachments.
- Work order information.
- Comments and communications.
You warrant that you have the necessary rights to such content and that it does not infringe third-party rights.
7. Subscriptions and Payments
7.1. Plans and rates
Services are offered under different subscription plans. Prices, features, and specific conditions are detailed on our Plans page or in the corresponding service agreement.
7.2. Billing
- Subscriptions are billed in advance according to the contracted period (monthly or annual).
- Prices do not include applicable taxes, which will be added as appropriate.
- Invoices are issued electronically.
7.3. Renewal and cancellation
- Subscriptions renew automatically unless previously cancelled.
- You may cancel your subscription at least 30 days before the renewal date.
- No refunds are made for unused partial periods.
8. Availability and Support
8.1. Service level
We strive to maintain 99.5% service availability. Scheduled maintenance interruptions will be notified in advance when possible.
8.2. Technical support
We offer technical support according to the contracted plan:
- Online documentation and knowledge base.
- Email support during business hours.
- Phone and priority support for higher plans.
9. Limitation of Liability
9.1. Disclaimer of warranties
Services are provided "as is" and "as available." To the maximum extent permitted by law, Maptainer disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9.2. Limitation of damages
In no event shall Maptainer be liable for:
- Indirect, incidental, special, or consequential damages.
- Loss of profits, data, or use.
- Business interruptions.
Maptainer's total liability shall not exceed the amount paid by you during the 12 months prior to the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Maptainer, its officers, employees, and agents from any claim, damage, loss, or expense arising from:
- Your use of the Services.
- Your breach of these Terms.
- Your violation of third-party rights.
11. Modifications
11.1. Changes to Terms
We may modify these Terms at any time. Significant changes will be notified at least 30 days in advance. Continued use of the Services after modifications take effect implies acceptance.

12. Termination

You may cancel your account at any time by contacting our support team.
12.2. By Maptainer
We may suspend or terminate your access if:

- You fail to make corresponding payments.
- Your use harms other users or our systems.
12.3. Effects of termination
After termination:
- Your access to the Services will be revoked.
- You may request export of your data for 30 days.
- After that period, data may be deleted.
13. General Provisions
13.1. Applicable law
These Terms are governed by Spanish law. Any dispute shall be submitted to the courts of the user's city of residence, unless the law permits another jurisdiction.
13.2. Assignment
You may not assign or transfer these Terms without our prior written consent.
13.3. Entire agreement
These Terms, together with the Privacy Policy and any specific service agreement, constitute the entire agreement between you and Maptainer.
13.4. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in force.
